BYLAWS OF THE SEAPORT OF UST'-LUGA
I. General
1. Bylaws of the seaport of Ust'-Luga (hereinafter "Bylaws") were developed according to Federal Law of November 8, 2007 No 261-ФЗ "On seaports of the Russian Federation and on amendments to particular legal acts of the Russian Federation"1), Federal law of April 30 1999, No 81-ФЗ "Merchant Shipping Code of the Russian Federation"2), General rules of ships navigation and anchorage at seaports of the Russian Federation and approaches to them3) (hereinafter "General rules").
2. These Bylaws include the description of the seaport of Ust'-Luga (hereinafter "the seaport"); rules of the ships entering and leaving the seaport; rules of navigation in the seaport water area; vessel traffic service zone description and rules of navigation in this zone; rules of ships staying in the seaport and indication of their berthing place; regulation of ecological safety ; quarantine regulations in the seaport, rules of radio communication in the seaport and its water area; the seaport borders information; sea areas A I and A 2 borders information of the Global Maritime Distress and Safety System (hereinafter "GMDSS"); technical parameters information for ships calling at the seaport; navigation period information; information on the areas of compulsory pilotage; the water area depths; dangerous cargoes processing information; the seaport ice navigation information; information reported by captains of ships staying at the seaport in case of threat of acts of unlawful interference in the seaport; navigation and hydrometeorological information transferred to captains of the ships staying at the seaport; other information specified by normative legal acts of the Russian Federation related to merchant shipping.
3. These Bylaws are to be executed by ships of any national or departmental identity and by private or juridical persons of any organization legal forms and proprietary forms performing work in the seaport.
4. Navigation of ships in the seaport and at the approaches to it, staying of ships at the seaport water area are carried out according to the General rules and the present Bylaws.
II. Seaport description
5. The seaport is located in the southeast part of Luga inlet of the Gulf of Finland, the Baltic sea and the Luga river estuary.
The seaport borders are determined by the Order of the Russian Federation Government of May 20, 2009 No 698-p4).
6. Navigation in the seaport is performed all year round, the seaport is available 24 hours a day; it has a passenger-and-freight constant multi-way checkpoint on the state border of the Russian Federation5).
7. Navigation in the seaport is performed in the following hydrometeorological conditions:
southwesterly and westerly winds prevail;
water level is subject to non-recurrent fluctuation of wind-tide nature, it has season changes: from December to May it sinks, from June - increases and reaches maximum in November;
sea water level: maximum + 146 cm, minimum - 109 cm, tidal fluctuations do not exceed 20 cm;
surge of the sea may reach 2.5 m with stormy northern, northwestern winds;
streams are subject to the influence of the prevailing winds, average speed does not exceed 0.2 knots, constant current speed of the river Luga is 0.3 - 0.5 knots and may increase up to 3.0 knots in high water spring period;
maximum ice thickness is up to 60-80 cm.
8. The seaport is not a shelter for ships in stormy weather except River area which is a shelter for ships of up to 5.4 m draught.
9. The seaport is part of operating zone of sea areas A 1 and A 2 of GMDSS.
10. The information on fairways, canals and recommended waterways of the seaport is given in Appendix No1 to these Bylaws.
11. The seaport deals with cargo handling, including dangerous cargoes, and provides passenger service.
12. The seaport technical parameters information about berthing is given in chapter X and in Appendix No 2 to these Bylaws.
13. The seaport provides vessels with stores, provisions, fuel, fresh water, facilities for reception of all kinds of garbage in accordance with the International Convention for the Prevention of Pollution from Ships, 19736) (hereinafter "MARPOL"), carries out repairs of ship's equipment and diver's survey.
14. Tug assistance is available.
Information on minimum quantity and power of tugboats for mooring operations in the seaport is given in Appendix No 3 to these Bylaws.
15. Ice navigation in the seaport is carried out within the period of ice formation according to the General rules and these Bylaws.
16. Information on places of anchorage in the seaport is given in Appendix No 4 to these Bylaws.
17. Information on the seaport areas and the areas of extreme caution to navigation is given in Appendix No 5 to these Bylaws.
18. Information on the channels of Very High Frequency (hereinafter VHF), used for communication in the seaport, is given in Appendix No 6 to these Bylaws.
19. Information on the schedule of the GMDSS Radio centre communication is given in Appendix No 7 to these Bylaws.
20. Information on the areas of compulsory pilotage in the seaport and approaches to the port is given in Appendix No 8 to these Bylaws.
21. The seaport is included in the list of the seaports of the Russian Federation which may be entered by vessels and other nuclear-driven craft with radiation hazards7).
III. Rules of entering and leaving the port
22. Information on vessel's entering and leaving the seaport is reported to the Harbour Master at www.portcall.marinet.ru.
23. Vessels' clearing in and out is performed 24 hours a day.
IV. Rules of navigation in the seaport water area
24. In the seaport a regulatory procedure of vessels traffic and anchorage according to the schedule is in force. The schedule of anchoring, berthing and navigation in the seaport is approved by the Harbour Master daily and is based on the information about the vessels calling at the seaport which is reported in compliance with item 22 of these Bylaws and placed at www.pasp.ru.
25. Vessels' traffic in the seaport water area, going to anchor and leaving the anchorage are regulated according to the schedule of anchoring, berthing and navigation in the seaport by the Vessel Traffic Service (hereinafter "VTS").
26. The seaport is entered and left by vessels through Luzhskiy Fairway No 19, Luzhskiy Morskoy Kanal, Severnyy Podchodnyy Kanal, Luzhskiy Zapadnyy Fairway No 21, Recommended Tracks (hereinafter "RT") Nos 21 and 22 and Ust'- Luzhskiy Kanal.
27. Navigation in the seaport areas Nos 354, 355 and 356 is to be performed with extreme caution.
28. There is a one-way traffic along Luzhskiy Morskoy Kanal, Severnyy Podchodnyy Kanal and Ust'- Luzhskiy Kanal .
29. In the water area of the Automobile- Railway Ferry Terminal (hereinafter "ARFT") not more than one vessel is permitted to navigate.
30. Vessels with draft of more than 13.7 m, when leaving the seaport, are to proceed along Severnyy Podchodnyy Kanal and Luzhskiy Fairway No 19.
31. Vessels of up to 320 m in length, up to 50 m breadth and up to 15 m draught, when entering and leaving the seaport are allowed to proceed along Severnyy Podchodnyy Kanal.
32. Traffic along Ust'-Luzhskiy Kanal to the River area of the seaport is prohibited for vessels:
at dark;
of more than 128.2 m in length;
of more than 5.4 m draught;
at wind speed of more than 8 m/sec;
when visibility is less than 5 cables.
33. Traffic along Luzhskiy Morskoy Kanal is prohibited for vessels:
of more than 320 m in length;
of more than 50 m breadth;
of more than 13.7 m draught.
34. Embarking or disembarking a pilot is carried out:
when entering or leaving the seaport from the side of Luzhskiy Fairway No 19 - at midchannel light buoy Kolganpya No 1 in position Lat.59°56,38' N., Long. 028°34,72' E.;
when entering or leaving the seaport from the side of RT No 22 - in position Lat.59°42,53' N., Long. 028°17,48' E.;
when staying at the seaport - at berthing places.
35. In the area of compulsory pilotage the following vessels have a pilot exemption:
small size vessels;
sport sailing vessels with power-driven engine;
coastal fishing vessels;
vessels engaged in service and supply of vessels only in the seaport water area and at the approaches to it, transport infrastructure of the seaport (hereinafter "port fleet vessels") of gross tonnage 50 and less.
36. When the visibility is less than 5 cables, vessels traffic in fairways, canals and recommended tracks of the seaport is not allowed except for inbound and outbound vessels .
37. Navigation speed:
in Ust'-Luzhskiy Kanal and in the Luga river should not exceed 6 knots;
in Luzhskiy Morskoy and Severnyy Podchodnyy Kanal should not exceed 8 knots.
38. Navigation in Luzhskiy Morskoy and Severnyy Podchodnyy Kanal is allowed when the visibility is not less than 5 cables with western, southwestern and northwestern wind at a speed of not more than 12 m/sec.
39. Embarkation and disembarkation of people on ships at anchor is allowed at a wind speed of not more than 10 m/sec and wave height not more than 0.5 m.
40. Navigation in the seaport water area is not permitted when visibility is less than 5 cables and wind speed is more than 12 m/sec, except vessels equipped with operative radars, course indicators and VHF radio installations.
41. In the seaport waters the navigation of sport sailing vessels is not permitted except sport sailing vessels with operative power-driven engine.
V. Description of operating zone of Vessel Traffic Service and rules of navigation in this zone
42. The Regional Vessel Traffic Service (hereinafter "RVTS") which includes the seaport VTS, operates in the eastern part of the Gulf of Finland water area, limited by Long. 26°30,00' E within the territorial sea of the Russian Federation.
43. Communication with RVTS is performed 24 hours a day on VHF Channels 74 and 10 , call sign "Petersburg - Traffic".
44. The operating zone of the seaport VTS covers the Gulf of Finland water area between the arc with a range of 18.5 nm with a centre in position Lat. 59°47,90' N., Long.028°29,80' E and its radii in the direction of 200° and 90° limited from the north by the operating zone border of RVTS.
45. Communication with VTS in the seaport is performed on the VHF channels listed in Appendix No 6 to these Bylaws. The ships in the operating zone of the seaport VTS keep constant radio watch on VHF Channels 14, 16 and 69.
46. One hour before entering the operating zone of the seaport VTS, an incoming vessel's master must communicate with the VTS on VHF Channel 76, call sign " Ust-Luga -Traffic".
47. An incoming vessel, while crossing Lat. 60°00,00' N, is to get RVTS permission to stop radio watch on VHF Channel 10 and communicate with the seaport VTS on VHF Channel 76, call sign "Ust'-Luga Traffic".
48. An outcoming vessel, while crossing Lat. 60°00,00' N, is to get permission of the seaport VTS to stop radio watch on VHF Channel 76 and communicate with RVTS on VHF Channel 10, call sign "Petersburg -Traffic".
49. Before getting underway, a vessel is required to get the VTS permission for traffic clearance. Information of the ship's traffic clearance is reported to the Harbour Master by VTS.
VI. Rules of vessels staying at the seaport and indication of anchorage
50. Vessels' staying at the seaport is available at the anchorages shown in Appendix No 4 to these Bylaws and at berths.
51. With north and northwest winds at a speed exceeding 17 m/sec and wave height more than two meters, ships staying at anchorage No 11 are required to leave the seaport.
52. Manoeuvring in the north area of the seaport is performed:
at terminal Novaya Gavan' at berth No 1 - for ships of less than 140 m in length, breadth up to 23 m, draught up to 7.35 m;
at Terminal of liquid cargo in bulk at berths Nos 1,2,3,4 and 5 - for ships of up to 320 m in length, breadth up to 50 m, draught not more than 15 m ;
at European Sulphur Terminal at berths Nos 5 and 6 - for ships of up to 250 m in length, breadth up to 32.2 m, draught not more than 13.7 m;
at Universal Transshipment Terminal at berths Nos 3 and 4 - for ships of up to 250 m in length, breadth up to 32.2 m, draught up to 13.7 m;
at Coal Terminal at berth No 1 - for ships of up to 250 m in length, breadth up to 32.2 m, draught up to 12.2 m;
at Coal Terminal at berth No 2 - for ships of up to 250 m in length, breadth up to 32.2 m, draught up to 13.7 m.
53. In the south area of the seaport manoeuvring is performed:
at Multipurpose Transshipment Terminal "YUG 2 " at berths Nos 5 , 22,23, 2 and 1 - for ships of less than 220 m in length, breadth up to 32.2 m, draught up to 10.5 m;
at Automobile Railway Ferry Terminal -for ships of up to 210 m in length, breadth up to 28.7 m and draught up to 7.2 m;
at Ust'-Luga Container Terminal at berths Nos 52 and 53 - for ships of up to 250 m in length, breadth up to 32.2 m, draught up to 11.2 m.
54. Anchorage of small size vessels may be obtained on the left bank of the Luga river outside the fairway.
55. Ships' mooring in the seaport is carried out by a mooring team of linesmen which number depends on the ship's gross tonnage :
for a ship of less than 500 gross tonnage - 1 mooring linesman;
for a ship of gross tonnage between 501 and 3,000 - not less than 2 mooring linesmen;
for a ship of gross tonnage between 3,001 and 10,000 - not less than 4 linesmen;
for a ship of 10,000 gross tonnage or more - not less than 6 mooring linesmen.
The chief of the mooring team must be provided with radio communication with the ship being moored.
56. Tug assistance during mooring is not compulsory :
for a twin propellers ship equipped with a thruster;
for a ship of less than 150 m in length with twin propellers.
57. Mooring to the berths of Automobile Railway Ferry Terminal with letting go an anchor is not permitted.
58. Letting go an anchor at a distance of 70 m from Berth No 1 of Multipurpose Transshipment Terminal is not permitted.
59. Ships staying at berths are permitted to try the main engine to check it before unmooring and in case of emergency to provide safety of the crew, ship, hydrotechnical constructions and to prevent ecological pollution.
60. Shifting for a distance of not more than 50 m is available without tug assistance and taking a pilot, the main engines being ready to start.
61. Shifting of tankers along the berth by means of mooring lines is not permitted.
62. Shifting of the vessel made fast alongside another vessel is prohibited.
63. Shifting of large-capacity vessels of 30,000 tons deadweight and more in ballast , Ro-Ro or Ro-Flow ships, container ships and self-propelled floating cranes is permitted at a wind speed not exceeding 12 m/sec.
64. Shifting of dumb and self-propelled ships with non-operative main engines, steering and/or anchor gear, is permitted at a wind speed of not more than 8 m/sec.
65. Vessels berthed in the seaport must be ready to leave the berth immediately if the wind rises or if there is the weather forecast warning about northern and northwestern winds exceeding speed of 17 m/sec and height of waves over 1.5 m, and proceed to anchorage or out of the seaport borders according to the Harbour Master's instructions.
VII. Rules of ecological safety and quarantine in the seaport
66. Reception of all types of ship's garbage given in Annexes I, IV and V to MARPOL is provided.
67. Ship's garbage is discharged on special barges or special trucks.
68. During loading and discharging of oil and oil products and while performing ship's bunkering operations in the seaport water area, the ships are guarded by floating booms for all the period of cargo or bunkering operations, except for the ice formation period in the seaport water area.
69. Discharge of segregated ballast in the seaport is permitted if it was taken in the Baltic and North seas, and/or changed or received in the area of the northeast Atlantic and the North sea if the distance from the nearest land was not less than 50 nm and sea depth not less than 200 m, each operation shall be recorded in the ship's log book.
70. A ship with a sick person on board with symptoms suggesting a dangerous infection, is berthed to anchorage No 11 with all the crew, passengers and cargo for epidemic preventing procedures.
VIII. Rules of usage of special means of communication on the seaport territory and water area
71. Vessels underway as well as the ones at anchorage and at wharves of the seaport must keep constant radio watch on VHF Channels 76 and 14.
72. Communication with a vessel, a pilot and tugboats is carried out on VHF Channel 6, call sign "Ust'- Luga- Pilot".
73. Information about the seaport water area pollution is to be transferred:
from ships - to the Harbour Master of the seaport on VHF Channel 14, call sign "Ust'-Luga-Radio-5";
by juridical persons employed in the seaport or private persons - to the Harbour Master of the seaport by telephone or any other means available.
74. Information about extra communication means including telephone numbers, email, fax, is given at www.pasp.ru.
75. VHF channels given in Appendix No 6 to these Bylaws are not permitted for communication between the shore-based persons.
IX. Information on the borders of sea areas A1 and A 2 of the Global Maritime Distress and Safety System
76. In the seaport water area there are sea areas A1 and A2 of GMDSS which are informatively connected with St.-Petersburg Search and Rescue Coordinative Centre .
77. The border of GMDSS sea area A1 is outlined with operating range of 150 nm from the coast station in St.-Petersburg in position lat.59°53,00' N and long. 30°13, 00' E westward.
78. Communication in GMDSS sea area A2 is provided by the joint work of coast stations of St.-Petersburg, Gorky, peninsula Karavalday with operating range between 200 and 250 nm centered in position lat. 59°59,00' N, long. 29°07, 00' E.
X. Information on the seaport technical parameters for berthing and water area depths
79. The seaport is available for ships of 320 m in length, breadth up to 50 m and draught up to 15 m.
80. Information on technical parameters for berthing in the seaport is given in Appendix No 2 to these Bylaws.
81. The seafarers are notified of the acceptable ships' draughts in the seaport water area and at berths by the Harbour Master annually and in the event of any changes.
XI. Information on dangerous cargo handling
82. Handling of dangerous goods of classes 1 - 9 prescribed by the International Maritime Organization (hereinafter "IMO") is available in the seaport.
83. Dangerous goods of classes 1-7 prescribed by the IMO are allowed to be brought into the seaport only for direct transshipment from motor transport or railway transport to the ship, from the ship to motor or railway transport.
XII. Information on ice navigation in the seaport
84. Start and completion of ice-breaker assistance for ships in the seaport water area and approaches to it are announced by the Harbour Master.
85. Ice-breaker assistance headquarters is set up to provide ice navigation in the eastern part of the Gulf of Finland.
86. Information about the ship's Expected Time of Arrival at the Convoy Meeting Point (hereinafter "CMP") is sent 72 hours in advance and confirmed 24 hours prior to the arrival at CMP according to item 22 of these Bylaws.
The schedule of ice-breaker assistance for convoy as well as the number of convoyed ships are arranged by the Harbour Master by 10:00 hrs on daily basis and placed at www.pasp.ru. If the ice conditions change, ice convoys schedule is compiled by 20:00 hrs on daily basis and is given on the website.
87. Depending on the ice situation forecast in the seaport water area, the Harbour Master is to impose ice restrictions for ice class in compliance with Appendix No 9 to these Bylaws and announce CMP location. A notice of the ice navigation restrictions and CMP location is published at www.pasp.ru not later than 14 days before they enter into force.
The ice navigation restrictions stated in Appendix No 9 to these Bylaws are not to be applied to ships of 20,000 gross tonnage and more, not older than 15 years of age, which conform to the requirements determined by the Russian Maritime Register of Shipping related to ice navigation without an ice-breaker assistance and in ice convoy. In this case the restrictions of ice navigation regime determined by the Russian Maritime Register of Shipping for such ships shall be applied.
88. The inbound ships are to proceed to CMP using VTS assistance. Ships not capable to proceed to CMP by their own power are provided with an ice-breaker assistance on request of their shipowner (ship's captain). A ship proceeding in ice conditions to or out of the port in ice convoy shall ensure manual mode of the main engine control whenever necessary.
89. Ice-breaker assistance is carried out by port and liner ice-breakers in ice convoys. In case a vessel cannot proceed with an ice-breaker assistance for convoy, it may request an individual ice-breaker assistance which is arranged upon availability of ice-breakers not engaged in ice convoy.
90. Formation of ice convoys is made according to item 86 of these Bylaws by the Harbour Master and is based on:
- the time of the vessel's approach to CMP;
- time of request submission for entering or leaving the seaport;
- priority order established by General Rules;
- ice restrictions.
On arrival at CMP the vessel is to contact an ice-breaker by VHF and act according to the instructions of the ice-breaker's captain. The RVTS is to assist the vessel to communicate with the ice-breaker in case of emergency.
91. Depending on the actual ice conditions at the approaches to the seaport, at the water area, and taking into account their technical parameters, vessels may proceed the course using the RVTS instructions without assistance.
When proceeding without an ice-breaker assistance, a vessel shall report the ice conditions on the route when passing reporting points and at the request of the RVTS.
92. A vessel proceeding in ice convoy is to change the VHF channel at the command of the ice-breaker.
93. Ice around a vessel which got stuck is permitted to be split off only by an ice-breaker.
94. From the time of arrival at CMP to enter the seaport, the vessel is to be stuffed with sufficient stock of fresh water, provisions and fuel for the period of not less than 14 days. Should a vessel be waiting for the ice-breaking service for more than 14 days from the time of arrival at CMP, the Harbour Master is to take proper measures to conduct the vessel to the seaport.
XIII. Information on the reports of captains of ships staying at the seaport in case of threat of unlawful interference act
95. If there is a hazard of unlawful interference act in the seaport, the ship's captain or the ship security officer without delay is to report it to the port facility security officer as well as to the Harbour Master.
96. The security level of port facilities and ships staying in the seaport, as well as information about any changes in the level, is to be reported to the Harbour Master.
97. Announcements about threat of unlawful interference acts in the seaport, as well as about the security level changes and confirmation of the reception of these announcements, are made immediately on VHF channels after the announced circumstances occur.
98. All the incidents related to finding precarious objects or explosive devices, signs of preparing and realization of unlawful interference acts, facts of illegal boarding, receiving any information about facts of threat of terrorism, of all infractions or dubious persons in the seaport are to be immediately reported by the ships' captains to the Harbour Master, the port facility security officer on VHF channels or via additional means of communication. This information is to be brought to the notice of all concerned persons by the Harbour Master.
XIV. Navigational and hydrometeorological information for captains of ships staying at the seaport
99. Information about the GMDSS radio centre schedule is given in Appendix No 7 to these Bylaws. The GMDSS radio centre transmits hydrometeorological, ice and navigational warnings.
100. The Harbour Master announces to the ships the following information on VHF Channel 14:
- meteorological information and warnings;
- navigational aids information;
- hydrotechnical facilities information (changes in the schedule);
- information on permissible draughts;
- information on navigational restrictions in the seaport water area;
- information on the factors obstructing ships traffic.
101. Ships shall acknowledge the receipt of very important messages and gale warnings .

INFORMATION ON THE SEAPORT AREAS AND AREAS OF EXTREME CAUTION OF NAVIGATION
The seaport area Novaya Gavan' is situated in the area of a new harbour Ruch'i. It is used for handling ships of Ro-Ro type and container ships with a draught up to 7.35 metres.
The North area of the seaport extends from the Khabolovka river estuary northward to Terminal of fertilizers transshipment. This area carries out handling of ships not exceeding 15 metres of draught, crude oil tankers, oil tankers of 150,000 deadweight, bulkers up to 100,000 deadweight, ships carrying general and special cargoes.
The South area of the seaport extends from the Terminal of liquefied petrolium gas as far as the Port fleet base located in the estuary of the Khabolovka river. This area carries out handling of ships which draught does not exceed 11.2 metres, container ships, Ro-Ro vessels, general cargo carriers, passenger-cargo ships, cargo railway ferries and gas carriers.
The River area of the seaport extends from the Luga river estuary up to the automobile bridge. It is available for cargo ships which length does not exceed 128 metres, and with not more than 5.4 metres draught. There are terminals for general cargo handling, industrial wharves of Ust'-Luga ship-repair yard, Ust'-Luga fish factory terminal, lay-by berths for port fleet ships.
Automobile-railway ferry terminal (further ARFT) is located in the south part of the seaport of Ust'-Luga and is a part of United multipurpose passenger -cargo automobile-railway ferry terminal "Ust'-Luga - Baltiysk - ports of Germany". It performs handling of railway and automobile ferries and Ro-Ro ships. ARFT consists of a ferry pier, sea ramp junction, shore ramp junction, port railway track, transshipment area, ramp with lifting gear and the systems which provide ARFT functioning .
